These Terms of Service ("Terms") govern your use of TruckArmyShop.com (the "Site") and any purchase you make from Truck Army. The Site is operated by Riverbend Enterprise Group LLC dba Truck Army ("Truck Army," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order on the Site.
2. Products and Fitment
We make every effort to display products, descriptions, images, and fitment information accurately. Product information is often provided by manufacturers and may change without notice. Colors and finishes may vary slightly from images. You are responsible for confirming that a product fits your vehicle's year, make, model, and trim before ordering. If you have questions about fitment, please contact us before purchasing.
3. Pricing and Availability
All prices are in U.S. dollars and may change at any time without notice. Products are subject to availability. Despite our efforts, a product may occasionally be listed at an incorrect price or shown as available when it is not. If this happens, we reserve the right to cancel the order and issue a full refund, even after an order confirmation has been sent.
4. Orders
Your order is an offer to purchase. We may accept, decline, or cancel any order for any reason, including product unavailability, pricing or listing errors, or suspected fraud. If we cancel an order after payment, you will receive a full refund.
5. Payment and Taxes
Payment is due at the time of purchase. You agree to provide accurate billing information. Applicable sales tax will be calculated at checkout based on your shipping address.
6. Shipping and Delivery
Products ship directly from our distribution and manufacturer partners, so items in one order may arrive in separate shipments from different locations. Large or heavy items may ship by freight carrier and may require an appointment and a signature at delivery. Delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, or other events beyond our control. Please follow the delivery inspection steps in our Return & Refund Policy.
7. Returns and Refunds
Returns, refunds, and damage claims are governed by our Return & Refund Policy, which is part of these Terms.
8. Installation and Use
Many products require proper installation. We strongly recommend professional installation. You are responsible for following all manufacturer instructions, warnings, and weight ratings. Truck Army is not responsible for damage, injury, or loss resulting from improper installation, misuse, modification, or exceeding a product's rated capacity. Some products, such as lift and leveling kits, lighting, and exhaust components, may be regulated by state or local laws. You are responsible for making sure products are legal for use on your vehicle where you live.
9. Warranties
Products are covered only by their manufacturer's warranty, where one is offered. Truck Army does not provide a separate warranty. We'll gladly help you with manufacturer warranty claims. To the fullest extent permitted by law, Truck Army disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so these exclusions may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by law, Truck Army will not be liable for any indirect, incidental, special, or consequential damages, including lost profits, vehicle downtime, or labor costs, arising from your use of the Site or any product. Our total liability for any claim related to a product will not exceed the amount you paid for that product. Some states do not allow these limitations, so they may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Truck Army and Riverbend Enterprise Group LLC from any claims, damages, or expenses arising from your misuse of the Site or products, your violation of these Terms, or your violation of any law.
12. Intellectual Property
The Truck Army name, logo, slogan, and Site content are the property of Riverbend Enterprise Group LLC and may not be used without our written permission. All other brand names, product names, and trademarks belong to their respective owners and are used only to identify their products.
13. Accounts
If you create an account, you are responsible for keeping your login information secure and for all activity under your account.
14. Prohibited Uses
You agree not to use the Site for any unlawful purpose, to interfere with its operation, to submit false information, or to attempt unauthorized access to any part of the Site or its systems.
15. Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the content or practices of those sites.
16. Privacy
Your use of the Site is also governed by our Privacy Policy.
17. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in North Carolina.
18. Changes to These Terms
We may update these Terms at any time by posting the revised version on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.
